Rand Paul Urges DOJ to Charge Fauci to Test Biden’s Autopen Pardon

Arizona Democratic Sen. Ruben Gallego is launching an effort to challenge a new Trump Administration immigration policy that could require many green card applicants to leave the United States and complete the process abroad.

According to a report from The Hill, Gallego is not only seeking to overturn the policy itself but is also pursuing a procedural strategy that could make it easier for Congress to reverse the change.

The dispute revolves around a recent U.S. Citizenship and Immigration Services (USCIS) policy affecting how certain immigrants obtain lawful permanent residency.

Senator Rand Paul (R-Ky.), chairman of the Senate Homeland Security Committee, is calling on the Department of Justice to charge Dr. Anthony Fauci with lying to Congress — which he says is necessary to challenge the legality of former President Biden’s controversial use of an autopen to issue last-minute pardons, including one to Fauci.

“I do believe Anthony Fauci committed a felony by lying to Congress,” Paul said in an interview with conservative activist Charlie Kirk. “You have to charge him with a felony, take him to court, and then the court will decide whether or not the pardon is upheld.”

Paul argued that only a formal prosecution and judicial review can determine whether Biden’s autopen-signed pardons — a method where a machine replicates the president’s signature — are constitutionally valid.

“You can argue until you’re blue in the face that you can’t do autopens and that maybe the president wasn’t aware of it,” Paul said. “But the only way to actually do this is to charge someone who has been pardoned.”

Fauci’s Testimony at Center of Controversy

The Kentucky Republican has long accused Fauci of knowingly misleading Congress during hearings on the origins of COVID-19 and the American government’s role in funding gain-of-function research in Wuhan, China.

“He testified in a very vigorous and heated and animated way that the NIH never funded gain-of-function research,” Paul said. “This is directly contradicted by the actual people who were involved in the funding.”

Paul has previously referred Fauci to the DOJ for prosecution, but no charges were filed under the Biden administration. Now, Paul sees a renewed opportunity — both to hold Fauci accountable and to challenge the broader issue of the legality of mass pardons executed by autopen.

Biden’s Final Pardons Under Scrutiny

Joe Biden, in the final days of his presidency, issued a sweeping round of pardons — many signed via autopen — covering controversial figures such as his son Hunter Biden, former Joint Chiefs Chairman Gen. Mark Milley, members of the House Jan. 6 Committee, and Anthony Fauci.

Biden insisted earlier this month that he personally approved every decision and directed staff to use the autopen due to the volume of documents.

While some legal experts believe autopen use is constitutionally permissible if the president explicitly authorizes it, others argue that the practice undermines the seriousness and individual consideration traditionally required for presidential pardons.

Will DOJ Act?

Paul emphasized that without a direct challenge in court, the Biden-era autopen pardons will go untested and become a precedent.

“I think Anthony Fauci is the most likely to be chargeable,” Paul said. “There are other people — Hunter Biden could be charged as well — but someone has to be charged.”

Legal scholars note that no federal court has ever ruled definitively on the constitutional validity of an autopen-signed pardon. A legal challenge could lead to a landmark case on the scope of presidential pardon powers under Article II of the Constitution.

Political Implications

Paul’s comments come amid a broader GOP effort to reexamine the actions of Biden administration officials and restore public accountability.

If the DOJ pursues charges against Fauci or others who received Biden pardons, the courts may ultimately be forced to determine whether an autopen signature is equivalent to the president’s personal act.

For now, Paul is urging the DOJ to take action, warning that failing to test the limits of the autopen could set a dangerous precedent.
