Special Master Deals Loss to Trump FBI Raid Case in Latest Ruling

The appointed to independently review materials seized during the 's raid of Trump's residence handed Trump's legal team a big loss.

On Tuesday, Judge Raymond Dearie told the former president he must provide evidence of the records' declassification or else he will have to assume the records seized by the FBI are indeed classified, according to The Washington Examiner.

“How am I going to verify the classification? … What business is it of the court?” Dearie asked during the Tuesday hearing. The Eastern District of New York judge suggested that the DOJ had given “prima facie evidence” that the records were classified and said that “as far as I'm concerned, that's the end of it.” He went on to press Trump's lawyers on why that shouldn't be the end of it.

Trump's lawyer Jim Trusty said Tuesday, “We're not in a position nor should we be in a position at this juncture to fully disclose a substantive defense.” Dearie told Trump's team, “You can't have your cake and eat it.”

The move comes after Trump's team acknowledged in a Monday filing that the former president could potentially face criminal charges.

In its filing, Trump's team expressed hesitancy to provide specifics on what may have been declassified because the issue may be a defense against future criminal charges. (RELATED: Trump Legal Team Admits Former President Could Face Criminal Charges)

Trump's lawyers wrote that, if they were forced to disclose this specific declassification evidence, “the Special Master process will have forced the Plaintiff to fully and specifically disclose a defense to the merits of any subsequent indictment without such a requirement being evident in the District Court's order.”

“The Draft Plan requires that the Plaintiff disclose specific information regarding declassification to the Court and to the Government,” Trump's lawyers said Monday. “We respectfully submit that the time and place for affidavits or declarations would be in connection with a Rule 41 motion that specifically alleges declassification as a component of its argument for return of property.” Rule 41 relates to motions seeking to have cases dismissed.

  1. Crooked bunch of no goods. Anything to keep him away from running. They have been trying since before he ran the first, the whole time he was in office, and haven’t let up since he left office. These people are the most corrupt humans in this country. You can tell by the way they have run this country in the past two years. There have been more laws broke by this administration than any in the past. They have made up rules as they have gone and changed rules that didn’t fit the way they wanted. They have ignored the Constitution and done as they please and they continue to destroy our country and our freedom.

  2. Wait a minute, let’s watch the show and see how it unfolds. Remember, it’s pretty sure that what the FBI was looking for and wanted to secure is not what they imply. My suspicion is that Rudy and Donald already have the goods on the 2020 cheat, and much more. So, maybe this is a bait to force that information into evidence to expose it. Just hang on. Everyone is playing a dangerous game.

One piece of the evidence of declassification that the special master seeks is found in a Presidential Memorandum on Declassification of Certain Materials Related to the FBI’s Crossfire Hurricane Investigation, issued by then-President Trump on January 19, 2021. I have a copy of it, obtained online shortly after the raid on Mar-A-Lago. Trump had announced the declassification the previous October, in a directive to the DOJ, to declassify and make available to anyone who requested it the same material.

  7. Wait! What? Something isn’t right! Who got to Dearie? Or is he playing the fbi to show their hand? Trump says he declassified all the documents, I remember seeing on tv him saying just that! So—— what is the hang up here? Is Dearie on the take, or hanging Trump out to dry? Guess we will see.

  8. Simple, because President Trump said he declassified them, they are automatically declassified. That is all that is required.
