Stephen Miller Clashes With Fox News Host Over Deportation Case

White House adviser Stephen Miller pushed back hard against Fox News host Bill Hemmer’s characterization of a recent Supreme Court ruling that requires the Trump administration to “facilitate” the return of a Maryland man deported to El Salvador.

During a tense on-air exchange Monday, Miller argued the administration had acted properly in deporting Kilmar Abrego Garcia, an alleged gang member, despite court rulings labeling the deportation illegal. Hemmer questioned the evidence of Garcia’s current MS-13 affiliation. He has not been criminally charged in either the U.S. or El Salvador.

Garcia had lived in Maryland for years and was granted protection from deportation in 2019 by an immigration judge, who cited fears he would face persecution from gangs if returned to El Salvador. At the time, Immigration and Customs Enforcement (ICE) officials under the Trump administration did not oppose the court’s decision.

A U.S. District Court judge later ordered the federal government to return him to the United States, calling the deportation an “illegal act” and setting an April 14 deadline for his return.

The Supreme Court sided unanimously with the lower court ruling on April 11, rejecting the Trump administration’s emergency appeal and requiring federal officials to help “facilitate” Garcia’s return.

Miller, however, maintained that the deportation was justified based on national security concerns. “He was sent to the right place,” Miller told Hemmer, spinning the ruling as a win and framing the administration’s actions as necessary in confronting violent gang activity.

“This has been portrayed wrong for 72 hours in the news media. They said the most a court could ever compel you to do is to facilitate return which would basically mean if El Salvador voluntarily sends him back, we wouldn’t block him at the airport, we would put him back into [Immigration and Customs Enforcement] detention and then he would be deported either back to El Salvador or somewhere else,” Miller said. “The Supreme Court said that is the most that the government can do, so we won the case handily. The misreporting on this has been atrocious. He was not, no Bill, it’s important, he was not mistakenly sent to El Salvador. He’s an illegal alien from El Salvador, hold on, this is important.

“In 2019, he was ordered deported, he was a final removal order from the United States. These are things that no one disputes. Where is he from? El Salvador. Where is he a resident and citizen of? El Salvador. Is he here illegally? Yes. Does he have a deportation order? Yes,” Miller added.

The case has become further complicated by the stance of El Salvador’s president, Nayib Bukele, who met with President Trump on Monday. Bukele declined to return Garcia from the Salvadoran mega-prison, known as the Terrorism Confinement Center, signaling alignment with the Trump administration. Garcia’s wife, meanwhile, protested outside the White House demanding her husband’s return.

Critics argue the administration has not complied with the Supreme Court’s order, pointing to a lack of visible action to attempt to secure Garcia’s return. Supporters of the administration counter that the situation underscores a broader conflict between judicial rulings and the executive branch’s responsibility to enforce immigration laws and protect public safety.

Garcia unlawfully entered the U.S. in 2011 and eventually settled in the Maryland area, according to court documents. Following his arrest in 2019, documentation compiled by the Prince George’s County Police Department verified that Garcia was a documented member of MS-13, providing his alleged gang name and his rank within the gang.

While the Justice Department has admitted the deportation occurred due to an “administrative error,” Miller’s comments suggest the White House has no intention of reversing course—at least politically.
