Former Fox News host Bill O’Reilly said this week that federal authorities should consider questioning — and potentially charging — actor Robert De Niro over recent comments he made about President Donald Trump.
During a sit-down interview with MSNBC’s Nicolle Wallace, De Niro sharply criticized the Trump administration and became emotional while discussing the state of the country. The actor urged Americans to mobilize and protest, expressing doubt that Trump would leave office voluntarily.
“Well, he will never leave. We have to make him leave. You see, he jokes now about nationalizing the elections — he’s not joking. We’ve seen enough already. And everybody’s worried about it, but he means it,” De Niro said.
When Wallace asked whether he believed Trump would step down at the end of his term, De Niro reiterated his concerns.
“He ain’t leaving. No, no way. Let’s not kid ourselves. He will not leave. It’s up to us to get rid of him,” the actor continued.
De Niro also suggested that Trump might not respect future election results and called for large-scale public demonstrations.
“You start hearing it all over now,” he said. “It’s up to you. Damn right, it’s about the people. The people got — like Vietnam. You got to get out there and protest. The ‘No Kings’ coming. It’s got to be not 7, 8, 9 million. It’s got to be way, way more than that.”

He then calls on people to obstruct Trump’s election integrity measures at the polls in the midterms.

O’Reilly addressed the remarks on his program No Spin News, arguing that De Niro’s repeated use of the phrase “we got to get rid of him” could be interpreted as a threat against the president.
“Now, he said the words, ‘We got to get rid of him,’ three times. Any interviewer other than Nicolle Wallace would have said, ‘What do you mean by that? He’s elected. Seventy-seven million people voted for him. What’s, ‘We got to get rid of him’? Are you talking about impeachment? What are you talking about?’ Of course, Nicole Wallace doesn’t do that,” O’Reilly said.
O’Reilly went on to reference U.S. Code 871, which makes it a federal crime to threaten the president and other officials in the line of succession.
“So, [if] I’m watching this and I’m the head of the Secret Service — USC, US code 871, it is a crime to threaten not only the President of the United States, but the vice president and everybody else in succession. That’d be the Speaker of the House on down,” he said.
He added that, in his view, the Secret Service would be justified in questioning De Niro.
“OK, so I’m the Secret Service director and I’m seeing this three times: ‘We got to get rid of him.’ I got agents pulling De Niro in for a Q&A and he better have a lawyer. Now, you could charge him based upon his answers to the interrogation. If he takes the fifth — a refused answer on the grounds — you could charge him! And if he were convicted, he’d get five years in prison under this code,” O’Reilly said.
“But I’d make an example of this guy De Niro. And I wouldn’t do it for vindictive or politics. I wouldn’t do that. But enough’s enough on the threats! ‘We got to get rid of him’? What are you talking about? This is a serious situation — unlike the Gavin Newsom thing, which is ridiculous. This isn’t.”

De Niro has been one of Trump’s most outspoken celebrity critics for nearly a decade, frequently using award show appearances, interviews, and public events to denounce the president in blunt and often profane terms. He has endorsed Democratic candidates and supported legal challenges to Trump, framing his activism as a defense of democratic institutions.
In an earlier MSNBC appearance in October, De Niro praised several Democratic leaders who have opposed Trump’s policies in court and in Congress.
“There’s something,” De Niro said. “I like Hakeem Jeffries. I like… Chuck Schumer, Adam Schiff, they’re all great, strong. I like what Letitia James is doing. She’s fighting back. She’s saying, ‘f— you!’”
