Judge Blocks Sale Of InfoWars To The Onion

In a late-night decision on Tuesday, a federal bankruptcy judge in Houston ruled against approving the sale of Infowars, the controversial website founded by Alex Jones, to the Chicago-based satirical publication The Onion. This ruling creates a significant roadblock in a messy legal dispute that has seen two high-profile bidders jockeying for control of the website, and it further prolongs the contentious struggle for the future of Infowars and its associated assets.

Judge Christopher M. Lopez’s ruling effectively delays The Onion’s plan to acquire Infowars, which it had won at auction last month. The Onion’s bid was bolstered by the families of the victims of the 2012 Sandy Hook Elementary School shooting, who had won a $1.4 billion defamation lawsuit against Jones for years of implying that the massacre was a hoax. The Onion, known for its satirical takes on current events, had vowed to turn Infowars into a site mocking the type of conspiracy theories propagated by Jones, including those regarding Sandy Hook.

However, Judge Lopez’s decision placed the future of Infowars in limbo, as he instructed the court-appointed trustee, Christopher Murray, to develop an alternative resolution. The details of this plan remain unclear, and it was not immediately apparent what steps Murray would take in light of the ruling.

After being sued for defamation, Jones was found liable in 2022 and ordered to pay billions in damages. As part of his ongoing bankruptcy proceedings, the sale of Infowars became an essential part of the settlement process.

The Onion, represented by its parent company Global Tetrahedron, placed a bid worth $7 million to acquire the website, with $1.75 million in cash and the remainder supported by the Sandy Hook families. The families themselves had agreed to apply a portion of their potential earnings from the defamation judgment to assist with The Onion‘s bid, as part of an effort to ensure that Jones would not benefit from the sale of his assets.

By contrast, First United American Companies, a bidder associated with Jones, offered $3.5 million in cash for Infowars. Despite this higher amount, the trustee ultimately determined that the combined bid from Global Tetrahedron and the Sandy Hook families was superior due to its strategic significance and the alignment of interests.

As tensions flared, one of Jones’s legal representatives questioned how the Sandy Hook families could afford their numerous lawyers, prompting immediate objections from the other side. This only heightened the already charged atmosphere in the courtroom, where both sides clashed over the fairness and transparency of the process.

Ben Collins, the CEO of Global Tetrahedron, also expressed frustration, stating that the company was “deeply disappointed” by the decision. He emphasized that The Onion remained committed to securing a resolution that would benefit the Sandy Hook families and bring justice to the situation. Collins added that the publication would continue its efforts to secure the assets of Infowars, signaling that the battle was far from over.

Judge Lopez’s decision was rooted in procedural concerns. The case ultimately hinged on whether the bankruptcy auction was conducted properly, with Judge Lopez ruling that the sealed bid process — where bids were submitted in secret — had failed to maximize the potential value for creditors, including the Sandy Hook families. “It seemed doomed almost from the moment they decided to go to a sealed bid,” Judge Lopez said, noting that the lack of transparency had undermined the fairness of the process.
