House Minority Leader Hakeem Jeffries is facing an ethics complaint over his public calls to federal district judges to remove U.S. Attorney Alina Habba from her position.
Jeffries’ complaints about the Trump-appointed U.S. attorney stemmed from Habba’s decision to charge Rep. LaMonica McIver (D-N.J.) with obstructing Homeland Security agents during an altercation at an immigration facility in Newark
The incident occurred on May 9 at Delaney Hall, during what was described as a congressional oversight visit. McIver was joined by several Democrat colleagues and Newark Mayor Ras Baraka.
According to the U.S. Attorney’s Office for the District of New Jersey, McIver allegedly struck two federal officers — once with her forearm and again while attempting to block the arrest of Mayor Baraka. Baraka had entered a restricted area without authorization. He was briefly detained for trespassing, but the charges were later dropped.

Federal prosecutors claim McIver’s actions constituted assault and obstruction of federal officers in the performance of their duties.
McIver has denied the allegations, claiming the charges are politically motivated and amount to intimidation over her work on immigration oversight. Her attorney, Paul J. Fishman, called the case “political retaliation against a dedicated public servant who refuses to shy away from her oversight responsibilities” and vowed to prove her innocence in court.

“The so-called U.S. Attorney in NJ maliciously indicted Congresswoman LaMonica McIver for doing her job,” said Jeffries in a post on X.
“Habba is a woefully unqualified political hack who must go,” Jeffires continued.
“She must be rejected by the Federal District Court Judges who are considering whether to retain her.”
The Article III Project filed a House Ethics complaint against Jeffries over the weekend for “improperly inserting himself into a criminal proceeding.”
“This is clear corruption by House Democrat Leader Hakeem Jeffries.”
Habba’s confirmation has been held up in the Senate. However, if a majority of U.S. district court judges in New Jersey decide to allow her to retain her position on Monday, she could remain in the position through the Trump presidency.
Fox News noted that of the 17 sitting district court judges from New Jersey, 15 were nominated by Democrat presidents.
“A House member – particularly the House Democratic leader – who disagrees with the merits of a pending criminal case abuses his official position when he attempts to strong-arm federal judges to corruptly prejudice the ongoing criminal proceeding by firing the U.S. attorney for the purely political reason of protecting a partisan House colleague,” the complaint said, asking the House Ethics Committee to hold Jeffries “accountable.”
