An appeals court won’t save Hunter Biden from his imminent gun trial.
Despite his best efforts, the president’s son will almost certainly face a high-stakes criminal trial next month in Delaware.
As CNN reports:
The president’s son had asked the 3rd US Circuit Court of Appeals to dismiss the charges by overturning prior decisions from the trial judge that the case should move forward. But the appellate panel instead rejected Biden’s appeal, handing yet another victory to special counsel David Weiss, who brought the charges.
Weiss’ team successfully argued that the appellate court didn’t have jurisdiction to review the matter and therefore was required by law to dismiss Biden’s appeal.
“This appeal is dismissed because the defendant has not shown the District Court’s orders are appealable before final judgment,” the three-judge appellate panel wrote in a four-page ruling.
The trial is slated to begin in early June unless the parties reach a plea deal or some other agreement to resolve the case, which is always possible. There is still one additional motion to dismiss the case — it pertains to Biden’s rights under the Second Amendment — that the trial judge hasn’t decided yet.
Barring an unexpected resolution, a jury trial will begin at 8:30 a.m. on June 3, 2024.
After being indicted last year, Biden’s attorneys also unsuccessfully sought to dismiss his federal tax charges.
“Since its inception in 2018, the investigation of Mr. Biden has been compromised by politics. This case follows a nearly six-year record of DOJ changing its charging decisions and upping the ante on Mr. Biden in direct response to political pressure and its own self-interests,” they wrote. Last year, Politico’s Jonathan Lemire reported that Hunter expressed fears that he might need to flee the country in the event that Donald Trump wins the presidential election.
Besides the felony gun charge in Delaware, the younger Biden is facing three felony and six misdemeanor tax charges in California.
