ATF Attacks Gun Owners’ Pocketbooks with Pistol Brace Ban

's Department of Justice has issued a rule outlining new regulations that will affect some of America's most commonly owned firearms.

The ban on pistol braces announced Friday goes into effect 120 days after it was entered into the federal register and applies to many firearms including those on an AR platform as well as a litany of other pistol manufacturers.

Under the new rule, fiarems with a pistol brace must be registered with the agency under the National Firearms Act (NFA) and to keep in a compliance with the new relugartions and stay law abiding gun owners individuals must pay a tax stamp of $200 per such item.

Theoretically, this even applies to those weapons that are currently owned. To be in compliance with such regulations, owners must either register their weapon, modify it, or turn it in to the ATF if they do not take either the first or second action.

In a brief issued earlier this month, the National Rifle Association (NRA) warned of the effects of such a ban.

“If finalized, the rule would likely subject most firearms with attached braces to the provisions of the National Firearms Act (NFA), which include additional taxation, long wait times, and registration.

Since 2012, when Biden was serving as then-President Barack Obama's vice president, ATF has recognized that stabilizing braces serve a legitimate function, and the inclusion of a stabilizing brace on a pistol or other firearm does not automatically subject that firearm to the provisions of the NFA. That's because stabilizing braces were first designed and intended to help disabled veterans fire large format pistols.”

Notably, the NRA even accurately predicted the potential timing of the announcement of such a rule, stating the following:

“Now, it looks like ATF intends to move forward with the final rule despite the numerous problems that have been identified with the rule. While no definitive date has been set for the release in January, ATF has in the past released various rulings immediately before the National Shooting Sports Foundation's Shooting, Hunting, and Outdoor Trade Show (SHOT). SHOT Show 2023 is scheduled to begin on Tuesday January 17th.”

The announcement of the rule this past Friday has spured a flurry of activity from manufacturers, advocacy groups, as well as the National Shooting Sports Foundation (NSSF) itself which is the firearms industry trade association and host's SHOT show.

The timing of the rule in coordination with the show means that many of the firearms manufacturers are planning to display, demonstrate, and sell, are now under the purview of this rule.

    i believe this is Beyond the Powers of the ATF and will go before the Supreme Court and be Overturn like most if not ALL the Illegal Actions by the Biden Corrupt DOJ!

    • Yes, but how long will the courts be able to slow-walk the suits, leaving owners in the lurch. And even if overturned, which it should be, will there be refunds for those who paid this outrageous fee?

      • civil disobedience is a right of the people – those who choose to pay the “penalty” have only themselves to blame. This is an illegal law and should not be obeyed.

  2. Remove AR-15 pistol brace receiver extension. Install AR-15 pistol receiver extension. Keep on shooting. F Joe Biden. F the ATF. Is the Dunce Biden really this stupid? Yes he is.

  3. A photo accompanying the above article shows the backs of a couple of men whose shirts are emblazoned with the following ATF POLICE. While the ATF, more properly the BATFE might be described as TAX COLLECTORS, LAW ENFORCEMENT or INVESTIGATORS, by that stretch of imagination, or via whose imagination did the ATF ever become POLICE?

  4. Yet another over reach by unelected bureaucrats enacting ‘laws’ which they are not allowed to do.
    As others have noted, this will be challenged and likely overturned but how long will that take and how much of a burden will that place on shooters who truly need such devices? Apparently the bats didn’t heed the ‘warning’ they just got regarding ‘bump stocks’. OTOH that ruling took well over two years to wend its way through the courts via challenges.

    • How much damage to Constitutional Rights, you might remember those things, will be done while adjudication takes place, and then there is the possibility that this rubbish might survive judicial examination.

  5. The Congress can put a stop to this foolishness. Why it seemingly chooses not to is a question I don’t have an answer to, unless it turns out that members of Congress have forgotten their oath of office, or did not take said oaths seriously.
