Poll Finds What Americans Believe About Birthright Citizenship. Do You Believe It?

Coinciding with the U.S. Supreme Court’s landmark birthright citizenship ruling, a recent national poll found broad public support for granting citizenship to nearly everyone born in the United States.

“Sixty-five percent feel that citizenship should be granted to all children born on American soil, no matter the circumstances,” the Associated Press reported, citing its lastest AP-NORC poll, noting that “support for birthright citizenship varies based on the situation.”

“Three-quarters believe that children born in the U.S. whose parents who are in the country legally on work visas should be automatically granted citizenship. Fewer, though still more than half (58%), think children born in the U.S. whose parents are in the country legally on tourist visas should automatically be citizens,” the AP reports.

Americans are reportedly evenly split on the issue of granting citizenship to people born when their parents are in the United States illegally, with 49% each in opposition and support.

The 14th Amendment to the Constitution states “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

The phrase “subject to the jurisdiction thereof” has generally been understood to refer to diplomats and other dignitaries of foreign governments, who have diplomatic immunity and are not “subject to the jurisdiction” of state and federal laws.  Immigrants and visitors, both here legally or illegally, are subject to the jurisdiction of state and federal laws.

The AP notes “the nationwide poll was conducted April 16-20, 2026 using the AmeriSpeak® Panel, the probability-based panel of NORC at the University of Chicago. Online and telephone interviews using landlines and cell phones were conducted with 2,596 adults. The overall margin of sampling error is +/- 2.6 percentage points.”
