A federal judge in New Hampshire has issued a nationwide injunction against President Donald Trump’s executive order aiming to end birthright citizenship, despite a recent Supreme Court decision limiting such broad judicial actions.
U.S. District Judge Joseph Laplante — an appointee of former President George W. Bush — certified a class-action lawsuit representing children who could be denied citizenship under the order and granted a preliminary injunction. The Supreme Court’s earlier ruling restricted nationwide injunctions but allowed for class-action suits to provide broader relief.
As The Hill reports:
Laplante’s decision comes after the Supreme Court curtailed judges’ ability to issue nationwide injunctions against Trump’s policies but left open a door for challengers to try to seek broad relief by filing class action lawsuits.
Laplante’s ruling has the same practical effect as a nationwide injunction, as it applies to babies anywhere in the country. The class does not include parents, as sought by the plaintiffs.
He said he would stay the ruling for seven days so that the Trump administration can appeal.
The lawsuit, brought by the American Civil Liberties Union and others, was filed hours after the justices last month ruled 6-3 along ideological lines that nationwide injunctions likely exceed federal courts’ powers, cutting back a tool judges have used to block Trump’s far-reaching second term agenda.
Trump’s executive order, signed on his first day back in office, sought to deny U.S. citizenship to children born in the country to illegal immigrants or those on temporary visas. Critics argue this move contradicts the 14th Amendment, which guarantees citizenship to all individuals born in the U.S.
The order is set to take effect on July 27.

I believe the 14th amendment applied to slaves.
It looks like the judicial warfare against the democratically elected President of the United States of America, Donald J. Trump, is still alive and kicking. The opponents of the law and order are using any loophole left after the SCOTUS decisions. Who pays for the court proceedings? If it comes from the ACLU’s coffers, let it be. I will simply stop contributing to this organization. If the money comes from taxpayers’ pockets, that would be a much different reaction.
The 14th amendment was aimed at blacks who were born to slaves who’s ancestors were imported generations earlier. We must look at the original intent and stop perverting our constitution to destroy our beloved nation.
Citizenship only applies to individuals born in USA with at least one parent who is subject to the USA (not just any old enemy..are you insane?)!!
U.S. District Judge Joseph Laplante should just be suspended or removed from the bench for obviously ignoring the SCOTUS ruling.
These radical judges do not respect the Supreme Court or Chief justice Roberts. Why should we? If leftist judges can ignore the orders of the Supreme Court why can’t we.
Just another judge who thinks that he is the law.
TOWY
Ignore the commie judge, the Supreme Court says other wise and it’s the law of the country.
