Feds Plan to Sue Ducey Over Makeshift Border Barrier

The federal government intends to sue outgoing Governor (R).

Ducey drew headlines in recent days with one last determined effort to secure his state's border with Mexico before leaving office next month.

However, the government contends his wall of shipping containers is illegal and potentially dangerous. They add it interferes with the work of the U.S. Border Patrol.

The Arizona Republic reports:

Ducey sued the U.S. Bureau of Reclamation in late October, asking a judge to allow the state to continue placing shipping containers at the border near Yuma after officials with the federal agency sought to halt construction days earlier. The governor maintains Arizona has the legal authority to put the containers in gaps where the federal government, though having plans to build a barrier, has not yet done so.

“The State's actions have substantially curtailed federal personnel from freely accessing the border area, and Arizona's placement of armed guards on federal land risks putting federal law enforcement officials in danger,” the Justice Department Office of Legislative Affairs wrote in an email about its planned action obtained by The Arizona Republic. “Arizona's actions have also stymied federal efforts to complete construction of border infrastructure projects in certain locations.”

The planned lawsuit will be on behalf of the U.S. departments of Agriculture and Interior.

A spokesperson for Ducey wasn't immediately available for comment about the matter.

Ducey previously said he had no plans to remove the containers until a permanent border solution was in place.

His successor, Democrat Katie Hobbs, is scheduled to take the oath of office as Arizona's next governor on Jan. 2.

  1. The Federal Government has abdicated its responsibility to secure the border. Biden and his cronies have ignored federal law and balked T securing the border. Even Mark Kelly has as much as acknowledged this fact. How is it that Ducey can get the containers in place while the Fed lets the border wal material sit and rust awaiting work to take place for years?

  2. The Feds? Really the most corrupt people in America.. They think they can do anything they want. They have pushed the American people too far now. They better get back in their holes and stay there. They are helping the democrats to destroy America. Time to shut them down along with all unamerican government departments. Joe Biden go throw your screaming fits in the your basement. Your useless to America.

  3. Ducey should tell them to go investigate the 2020 election irregularities first.

    Then flip them the bird and tell them where else to go.

  4. States can’t take military action , UNLESS, they are being invaded ! Since the government won’t take action to curtail illegal entry, they have a constitutional right to take action. Read the constitution.

  5. Oh we can hardly wait for the female version of Biden to take over as our governor. How this nitwit ever received the votes is unbelievable! And every Arizonan who voted for this potted plant should be embarrassed and never allowed to vote again!!!
