Florida Abortion Law Ruled ‘Unconstitutional’

While new laws begin to take shape nationwide following the historic Dobbs ruling, 's abortion plans have hit a roadblock after a Tallahassee judge ruled Florida's 15-week abortion ban unconstitutional.

As CNN reports:

The law, which was set to go into effect on Friday, would allow exemptions in cases where a pregnancy is a “serious risk” to the mother or a fatal fetal abnormality is detected if two physicians confirm the diagnosis in writing.

In a verbal ruling, Second Judicial Circuit Court Judge John Cooper said he would be issuing a temporary statewide injunction that will go into effect once he signs the written order in the challenge brought by some Florida abortion providers. He said he will not be signing the order on Thursday.

The law was signed by Florida Republican Gov. back in April. In a statement, DeSantis' office expressed disappointment with Thursday's ruling but said they were confident that the law will “ultimately withstand all legal challenges.”

“The Florida previously misinterpreted Florida's right to privacy as including a right to an abortion,” the office said in the statement. “We reject this interpretation because the Florida Constitution does not include — and has never included — a right to kill an innocent unborn child. We will appeal today's ruling and ask the Florida Supreme Court to reverse its existing precedent regarding Florida's right to privacy. The struggle for life is not over.”

The law has no exceptions for rape or incest. Should it be enforced, all abortions in Florida will have to be reported to the state along with information explaining why the procedure occurred.

DeSantis has not yet personally commented on the ruling. The state's Supreme Court is all but guaranteed to decide the ban's fate.

  1. Judge was heard mutter something to the effect of “Must kill babies, must make sacrifice to Mullock!”

  2. Am I alone in this or does it seem to others that there is something else going on here? To me, if there were no other way to prevent an unwanted pregnancy, no such thing as contraception, or a “day after pill”, surgical procedure or adoption, then maybe I could understand the zeal for en vitro infanticide. Why the vitriol for those who want to save lives?
    Must be something else. A cult or fanatic religion? The “depopulation movement”? Racism, since 40% of abortions occur to African-American women and babies?
    What ever happened to “for the children”, Mrs. Pelosi. How is abortion on demand “for the children”?

    • I think that a lot of the zeal for pre-birth infanticide is to desensitize people to killing other human beings.

      If you can kill your own innocent child for no reason without a qualm, then it’s not difficult to support killing those who do not share your political views and stand between you and socialist utopia.

      The left is a death cult.

      • We said back in 1973 that legalizing abortion would introduce a culture of death and we were proven correct. Why so many spree killers and others? If life is worth NOTHING and we all are just evolved animals, why not kill someone who disses you or whose money you want?

      • Exactly. I don’t get why judges think they can overrule state legislatures. Do what the demonrats do, ignore him and enforce the law on the books.
        Protest at his home and threaten to burn it down like libs do.

      • This basically is the samething I had said in an earlier comment: …”When did murder only apply to unborn humans”…These people that want to be allowed to kill unborn humans don’t want to be held accountable for their actions…Once again we see the irresponsible generation that has been breeding like flies and letting their off spring run amok w/o proper parenting…thus we see todays society of that off-spring in which the next generation follows the same map…I think a law should be put in place where you can’t have children or impregnate someone until you have an IQ test along with a test measuring ones maturity and also one that measures responsible thinking….and anything else that proves the worthiness of an individual having the wherewithal to raise a child….let alone impregnate someone.

    • I agree with you there is something going on and my opinion is that the vile and control freaks that are running our country don’t want women to have a choice they would rather line the pockets of Planned Parent Hood who also lines their pockets

  3. The same people who are yelling “we have the right to murder out babys are the same ones who were yelling get the shot and we have to take your guns to protect the children. Not one of my guns in the last seventy years has shot a human. Doesn’t make much since to me.

  4. What a surprise, another liberal judge is blocking a state abortion law. The libs will most likely tie up in court every states laws regarding abortion until it gets back to the SCOTUS, then they can slap the libs down again. Too bad we can’t replace every left wing liberal judge in the country, that would make for a so much better country. We now have to purge all democrats from our government.

  5. Another commie judge who needs to be gone. The law is substantive and no there is no constitutional protection for abortion under the constitution.
