Focus on Prosecutor Could Derail High-Profile Cases

Federal judges are sharply criticizing the Justice Department’s prosecution of former FBI Director James Comey, calling the government’s approach “highly unusual” and raising serious concerns about prosecutorial norms and the legitimacy of prosecutorial appointments. The case, launched at the request of President Donald Trump, is now under heavy scrutiny.

At the center of the controversy is not just the indictment itself, but how the DOJ arrived at it.

Comey was indicted in September 2025, just days before the statute of limitations was set to expire. He faces two felony counts: making false statements to Congress and obstructing a congressional proceeding, stemming from his 2020 testimony about the FBI’s probe into alleged Russian interference in the 2016 election.

The DOJ’s lead prosecutor, Lindsey Halligan, was appointed only days before presenting the case to a grand jury. She has no federal trial experience and was placed in a specially-created role, bypassing normal appointment and vetting procedures.

CBS News reports that career prosecutors in the U.S. Attorney’s Office for the Eastern District of Virginia opposed the indictment. Trump, meanwhile, publicly celebrated the charges and suggested he “could get involved if I want.”

At a Nov. 5 hearing, Magistrate Judge William E. Fitzpatrick issued a scathing rebuke of the DOJ’s conduct.

He warned prosecutors against what he called an “indict first and investigate second” strategy and ordered the government to turn over grand jury transcripts and all materials seized from Comey adviser Daniel Richman — some of which may be protected by attorney-client privilege.

Fitzpatrick also questioned the legitimacy of Halligan’s appointment. If her appointment is ruled improper, the indictment could be tossed altogether.

“This is not a typical case,” he said.

For conservatives and legal institutionalists, the case exposes a number of serious structural concerns:

Comey’s legal team has filed motions arguing the prosecution is selective and vindictive, citing Trump’s own comments and the unusual DOJ posture.

If courts determine Halligan’s appointment violated constitutional or statutory rules, the result could be suppression of evidence or full dismissal — a serious blow to the government’s case.

The broader precedent matters too. A ruling in Comey’s favor could shape how politically sensitive cases are pursued — or abandoned — in future administrations.

The GOP finds itself in a complicated position. Comey, once viewed favorably by many on the right, has become emblematic of the deep state. However, if the case is viewed as a form of political retaliation rather than accountability, it could undermine Republican messaging about justice and the rule of law with independent voters.

In the longer term, the case could fuel interest in reforms to the DOJ appointment process and the oversight of politically sensitive prosecutions.

Yet even as Republicans celebrate his prosecution as long-overdue justice, some institutional conservatives fear the apparent irregularities — from rushed timing to questionable appointment authority and visible presidential pressure — could damage the credibility they hope to restore in the justice system. It’s a paradox: trying to purge political bias from federal law enforcement while risking the perception of weaponizing it in return.

    This has the smell of foreign or criminal influence or charges that will be earthshaking.

    Not surprised. Who would give anything of import about this case to the leaking for dimwit nitwits or bought judges and clerical staff. And the DOJ is the federal law, this just reeks of criminal intent of those after the data. The case is quite clear and this article smells like the dirty left trying to publicise their worry and transfer that to the public for some sort of twisting the opinions of anyone reading and listening up on this so necessary trial of a corrupt and law breaking past leader of the federal level of the FBI. And I have insider knowledge about the FBI. The level of corruption in the FBI because of Comey and Wray was bad, bad, bad. The working agents were unhappy about the corruption at the higher levels.

    Seems the original attacks on Trump by Letitia claiming to take him down as she promised voters and Comey setting Trump up and lying to him via his position as head of the FBI were themselves very unfair yet not one in these judges said a word or tried to assess the legal standing of their cases.

    Now the judges want this DOJ to turn over the evidence that they never asked the attorneys after Trump to provide because those trials were necessary to get rid of Trump and they had nothing amounting to much during the Witch Hunts. Certainly not enough to allow the witch hunts.

    Today the proof is in the records of the FBI for Comey that the DOJ has and Comey himself and what he admits or not because of his seconds own words and what was documented in the records.

    The proof for Letitia is her assessment of assets in that witch hunt on Trump. Her assessing the value of his assets presented for the money he borrowed against those assets to proceed with his other endeavers. What was a typical borrower to lender business process was corrupted per Letitia to establish grounds for a phoney lawsuit. She determined the value of his assets were considerably lower than claimed.

    The truth was the deal was made, the lender put the money up, and the funds were paid back within the timeline the lender expected and no big deal.

    This is a mountain that in reality was a mole hill. And the lenders are not stupid. They look at other issues than the assets up for collateral.

    I am a retired CPA. It took me a long time to fully grasp the lending terms for loans but eventually I understood that whole process. And it can be different per lender and everything involved including collateral.

    The fact that Letitia picked that and it was allowed to proceed said the others involved in the decision to use that for the lawsuit did not understand this particular part of a lenders typical lending process. And the judge did not understand it either. Ignorance I guess is bliss when you can drag people through months of harassment and loads of legal costs for NOTHING, NADA, ZIP, ZILCH!

    I sincerely hope Letitia pays for two things. First is her stunning ignorance and arrogance. Second she should have to repay every penny she cost in her rediculous lawsuit. I would have expected anyone in her position to understand more about the process she litigated in court. For her future I would like her name to be remembered for her foolish attack without fully understanding there was NO crime to litigate against. It was just a normal business transaction and she is too dumb to get it even though she apparently buys homes and deals with lenders herself. She lied to get a loan for an apartment house she did not live in but claimed was a primary home she resided in. She did much more in her purchase than Trump did. She lied about living in the property just to try for the lower rates a primary home gets! Is that fraudlent? YOU BET!
