Justice Department Sues Ducey for Installing Shipping Containers Along Border

It's official, the is suing Governor (R).

The filed the suit in the U.S. District Court for the District of Arizona, claiming his makeshift border barrier has trespassed on 10 miles of federal lands.

The Washington Examiner has more:

“In installing shipping containers on National Forest System lands, Arizona has widened roads and cleared lands for staging areas … cut down or removed scores of trees, clogged drainages, and degraded the habitat of species listed under the Endangered Species Act,” the lawsuit states.

The Biden administration asked the court to order Ducey to remove each container and pay for damages to the border.

However, Ducey's office shared with the Washington Examiner the state's attempt to remedy the situation earlier this week. Ducey had told the government the state was willing to help take down some of the project but pushed back against a number of claims against it.

Ducey's office sent the Biden DOJ a letter Tuesday in response to a letter the federal government had sent his office Monday warning of a forthcoming lawsuit.

The lawsuit against Ducey's wall comes four months after he issued an executive order starting its construction.

    • RH – check out that tattered old document known as the US Constriction says the Federal government can own and why.
      I know some legal beagle will claim that those have been superseded by legislation but that might very well be unconstitutional.

  1. Counter sue. The Fed govt. Is causing MORE damage to the state, than the state is causing to their policy. If necessary, block off the 10 miles of Fed land, if possible and confine the illegals there (too much/too awful, I know) and let the Feds take responsibility (which they’ve forfeited, after instigating the total crisis).

    • tom, many of us DO care but far too often we have been declared to have ‘no standing’ by too many ‘judges’. They have effectively neutered us and any complaints we have.

      • And I’d be willing to bet that a vast majority of those radical lower court judges were appointed by a democrat administration.

  2. Joe Biden wants the shipping containers removed because Hunter is complaining about a shortage of drugs that’s causing real high inflation on the price of cocaine.

  3. Biden, Pelosi, and Garland are concerned that the shipping containers are cutting back too much on the amount of fentanyl coming across the border killing so many of the young people in America.

  4. Bravo Gov Ducey! Some Republicans need to stand up and challenge him. He sits back as if he is king and isn’t concerned one iota if Americans like his decisions or not. The president won’t finish the wall, he wants the over 5 million who have come across our southern border in his first two years, so he wants no obstruction or fencing to impede the mostly single men from 160 different countries, Russia, on down. Stand firm. Get the best attorneys and Take it to Supreme Court, because Biden is President and his job is to protect Americans, which he doesn’t bother to do or obey the current laws of immigration. He CAN be impeached and soon.

  5. There are words for the hypocrisy of a vile Federal Government that will not face up to its responsibilities and enforce its own laws. In such a reprehensible scenario it it of course left up to the individual states to protect their citizens.
