Missouri AG Sues Jackson County Over Anti-Second Amendment Ordinance

In further evidence that Democrats don’t think they are subject to laws they disagree with, the Jackson County legislature has criminalized the purchase of handguns and ammunition by young adults, 18 to 20 years old, and prohibited them from possessing “semiautomatic assault rifles” despite the Second Amendment and Missouri state preemption law. This shouldn’t come as a shock to anyone, as criminality and the use of lawfare is leftist 101. Thankfully, Attorney General Andrew Bailey has announced that his office has filed a lawsuit challenging the ordinance and upholding his oath to preserve and defend the rights of Missouri residents. 

Bailey’s lawsuit, filed in partnership with Gun Owners of America, seeks to invalidate Jackson County Ordinance No. 5865, a blatant violation of both the United States Constitution and Missouri law preempting municipalities from enacting firearms restrictions that conflict with state laws. In fact, Missouri law reserves all authority to regulate firearms at the state level, as outlined in Section 21.750 of the Revised Statutes, expressly prohibiting local governments from creating and enforcing their own gun regulations.

“Jackson County leaders don’t get to nullify the Constitution just because they disagree with it… Their actions are a blatant attempt at lawfare to achieve their political agendas. We’re taking this fight to court to defend the rights of every Missourian, because all law-abiding adults are entitled to equal protection under the Constitution,” said Bailey.

Sure, this sounds great. Did Jackson County not get the memo? Of course they did. Additionally, Attorney General Bailey’s office reports that Jackson County’s own legal counsel pointed out that the ordinance would conflict with state law; however, the county legislature dismissed this legal advice, choosing to override a county executive veto and enact the ordinance regardless.

“When constitutional freedoms are threatened, my Office will take action… We’re standing up for the rule of law and the rights of every citizen,” according to Bailey.

While I commend the spirit of Attorney General Bailey, I must wonder if we’re not playing into the scam altogether. Democrats have been using lawfare for years to burn American tax dollars in litigation over already settled law that they refuse to accept and abide by. What makes these local lawmakers, or any lawmaker for that matter, so far above the law that they can willfully defy it?

What happens to ordinary citizens when we violate state law? The Attorney General doesn’t sue us, he indicts us, and we get a shiny new pair of bracelets to accessorize for the inevitable perp walk. I don’t mean to seem unappreciative, and I am indeed a fan of any attorney general who stands by their oath of office, but it’s time we start playing hardball and stop pretending that there is any end to the cyclical litigation that breeds perpetual lawfare without putting these subversives behind bars.

    Liberal Dems never change. They cannot wrap their mind around facts about anything that they just don’t like. In this situation, they believe they are above the State constitution.
    An example I have used many years is still relevant. (Yep. I’m old.) Back in the 1980s, the Chicago suburb Morton Grove banned hand guns. Dems went on many networks gushing that it was a tremendous victory of a little David again the giant, evil, heartless NRA.
    Within a few weeks, Kennesaw, GA passed a law that required all legally eligible adult residents to own a firearm.
    The national media descended in a hysterical mob. They predicted it would be a blood bath, with bullets flying 24 hours a day, robberies and murder rates would sky rocket, and people would shoot neighbors over the smallest disagreements. They screamed that dozens of children would be killed every month by playing with unsecured guns, stray bullets from gunfights, etc, etc.
    The only person who reported the actual text of the law was a young journalist from CNN. He went to city hall and showed the actual text of the law. Apparently got fired, because I never saw him on CNN again.
    The city law requires all legally eligible adults to own a gun. Unless:
    1) They have a moral, philosophical, or religious objection to owning one.
    2) Cannot afford one.
    3) Do not want to.
    The city had just legislated – choice – and the media lost their minds.
    The already low crime rate dropped to zero, and all the dire consequences networks ranted about have never happened.
    Every couple years, networks go back to Kennesaw, claiming that all the horrible things they predicted are going to happen any day now.
