New Law Subjects Trump to Sexual Battery Suit

Journalist E. Jean Carroll claims she was raped by former President Donald Trump in a dressing room at a luxury New York department store in the mid-1990s. Now, she plans to use a new law to bring the former commander-in-chief to court.

Under New York state’s new “survivors” law, alleged sexual assault victims have a one-year window to sue their accusers even if the statute of limitations has long expired.

Carroll plans to use the law to sue Trump for sexual battery according to court papers disclosed Tuesday.

Carroll’s lawyers also want to question the former president under oath. Earlier this year, her attorneys said that getting sworn testimony from Trump wasn’t necessary. They now argue in a letter to the judge that a deposition is warranted since Trump has “barely participated” with boilerplate statements in the fact-finding process.

The New York Times further reports:

She plans to file her new case against Mr. Trump on Nov. 24, the start of a one-year window in which the law allows such suits to be filed, Ms. Carroll’s lawyer, Roberta A. Kaplan, wrote in a letter to the federal judge overseeing the defamation lawsuit.

Ms. Kaplan said in the letter that she plans to ask Judge Lewis A. Kaplan of the Southern District of New York to have the two cases tried together on Feb. 6, when Ms. Carroll’s defamation lawsuit was scheduled for trial.

Carroll had previously sued Trump for defamation in 2019 when the then-president denied raping her and called her a liar. Trump has also denied ever defaming Carroll.

The letters from Ms. Kaplan and Ms. Habba were dated in August and had not previously been filed publicly by the court.

Ms. Carroll, a longtime advice columnist for Elle magazine, wrote in a 2019 book and in an article published in New York magazine about the assault that she accused Mr. Trump of committing.

Carroll first accused Trump in a June 2019 article in New York Magazine, which she then described in her book “What Do We Need Men For?: A Modest Proposal.” She also accused former CBS Corporation CEO Les Moonves of sexual assault.

According to ABC News, at least 18 women have accused Donald Trump of varying degrees of sexual misconduct. Most came forward with their allegations before his first White House run. Trump adamantly denies the allegations.

    I do not believe these laws will pass muster when presented to SCOTUS, see Article 1, section 9, clause 3 the no ex post facto law prohibition.
