Access to a common abortion pill will remain unchanged through at least Friday as the Supreme Court extends its pause until the end of the week.
Supreme Court Justice Samuel Alito, who handles emergency requests from the 5th U.S. Circuit Court of Appeals, announced the move in a brief order.
The Biden administration and the company that manufactures a brand name version of mifepristone have asked the high court to intervene and pause a ruling from U.S. District Judge Matthew Kacsmaryk earlier this month.
On Wednesday, the company that makes the generic version of the common abortion pill Mifepristone sued the FDA seeking to bar the agency from rolling back access to the drug if the Supreme Court allows sweeping restrictions to take effect.
The challenge filed in federal court in Maryland, according to Politico where the agency is headquartered, argues that if the FDA implements a court order suspending approval of the drug, mifepristone, it would be “depriving GenBioPro of its constitutional and statutory rights to market mifepristone without affording GenBioPro due process of law.”
GenBioPro claims that, before suing, it repeatedly approached the FDA to ask what the process would be for suspending approval and what rights the company has under that scenario and received no response.
“Notwithstanding the exigent circumstances and the numerous tools available to FDA, FDA has repeatedly refused to assure GenBioPro or the public that it will afford GenBioPro adequate procedures before suspending GenBioPro’s … approval,” the company wrote.
The pill is the nation’s most commonly used method of abortion.
