According to a new court filing, Special Counsel Jack Smith has charged a third individual over the alleged mishandling of classified documents at Mar-a-Lago by former President Donald Trump.
The new defendant is Carlos De Oliveira. According to CNN, De Oliveira is a maintenance worker who helped move boxes of classified documents around Mar-a-Lago after the Justice Department subpoenaed Trump for them. The New York Times identified him as the worker who drained the pool at Mar-a-Lago in October, flooding the room where surveillance footage is kept.
Additionally, Smith has brought multiple new charges against Trump involving the alleged alteration, destruction or concealment of evidence.
The additional charges facing Trump involve:
- Willful retention of national defense information
- Two obstruction counts (attempting to delete surveillance footage)
- False statements to the FBI
CNN further reports:
Former President Donald Trump and his aide, Walt Nauta, were charged last month. Both have pleaded not guilty to all charges.

CNN has previously reported that surveillance footage turned over to the Justice Department showed Nauta and De Oliveira, moving document boxes around the resort, including into a storage room just before Trump lawyer Evan Corcoran searched it for classified documents.

De Oliveira spoke to investigators earlier this year and his phone had been seized.

In a statement, a Trump spokesman called the charges “nothing more than a continued desperate and flailing attempt by the Biden Crime Family and their Department of Justice to harass President Trump and those around him.”
Nauta, Trump’s valet, faces two new charges in the 60-page superseding indictment as well, based on allegations the defendants attempted to alter or destroy evidence.
